SUBJECT:  Local Veterans' Employment Representative (LVER) Program

ORIGINATOR:  WIA Title III (Wagner-Peyser) (Veterans’ Services Unit)

BACKGROUND

The Secretary of Labor, acting through the Assistant Secretary of Veterans' Employment and Training (ASVET), has made available for use in each state, funds to support a Local Veterans' Employment Representative (LVER) Program designed to meet the employment needs of Veterans and Eligible Persons.

POLICY

It is the policy of the Employment Security Department (ESD) to promote and develop employment and training opportunities for Veterans and Eligible Persons through the utilization of the Local Veterans' Employment Representative (LVER) Program.

Staff Selection and Funding

The Secretary of Labor shall make available to each State with an application approved by the Secretary an amount of funding in proportion to the number of veterans seeking employment using such criteria as the Secretary may establish in regulation, including civilian labor force and unemployment data, for the State on an annual basis. The proportion of state LVER funding will reflect the ratio of:

  • The total numbers of veterans residing in the state that are seeking employment; to
  • The total number of veterans seeking employment in all states.

The formula allows for establishing minimum funding levels and hold harmless funding criteria.

A state shall employ such full or part-time Local Veterans’ Employment Representatives as the state determines appropriate and efficient to carry out the employment needs of eligible veterans in accordance with priorities determined by the secretary.

The LVER position(s) are in addition to and do not supplant any Disabled Veterans' Outreach Program (DVOP) specialist positions (see Policies and Procedures communication number 4032, Disabled Veterans' Outreach Program).

In the filling of LVER positions preference is given to qualified eligible Veterans or Eligible Persons. Preference is accorded first to qualified service-connected Disabled Veterans. If no Disabled Veterans are available, appointments are filled by qualified Veterans. If no qualified Veterans are available, qualified eligible persons are considered. Complete information regarding definitions related to Veterans and Eligible Persons can be found in Policies and Procedures communication number 4030, Services for Veterans.

In order to ensure that LVER staff meet the above requirements, the following documents are requested:

  1. Report of Separation from Active Duty, DD-214; and
  2. U.S. Department of Veterans’ Affairs (VA) award letter for establishing Civil Service Preference; or
  3. Military Disability Retirement Orders.

Copies of the documents cited are secured for all appointments and promptly forwarded to the Veterans' Services Unit within 15 calendar days from the date of appointment.

The distribution and use of funds provided under the LVER program are subject to monitoring by the U.S. DOL

Scope of Work for LVER Positions

The grant agreement includes assurances that all LVER staff exclusively serves Veterans and Eligible Persons. It is recognized that in certain situations, deviations from this requirement occur. Therefore, if a service delivery site utilizes an LVER to provide services to non-veterans for some reason, the time involved is charged to an account other than the LVER project code. In providing direct services to Veterans, however, under no circumstances does any other staff charge to the LVER project code.

LVER Duties and Responsibilities

  1. Ensure that veterans are provided the range of labor exchange services needed to meet their employment and training needs. Work with other workforce development providers to develop their capacity to recognize, and respond to these needs. Examples may include the following activities:
    a) Train other staff and service delivery system partners to enhance their knowledge of veterans' employment and training issues;
    b) Promote veterans as a category of job seekers in the workforce development system who have highly marketable skills and experience.
  1. On behalf of veterans, advocate for employment and training opportunities with business and industry, and community-based organizations. Examples may include the following activities:
    a) Plan and participate in any job fairs to promote services to veterans;
    b) Work with unions, apprenticeship programs, and business community to promote employment and training opportunities for veterans; and
    c) Promote credentialing and training opportunities for veterans with training providers and credentialing bodies.
  1. Establish, maintain, or facilitate regular contact with employers to develop employment and training opportunities for the benefit of veterans. Examples may include the following activities:
    a) Develop employer relations contact plans for the service delivery point, to include identified federal contractors. Components of the plan may include: telephone contacts; employer visits; and ongoing research and analysis of local market conditions and employment opportunities; and
    b) Coordinate with business outreach representatives in the WorkSource Center to facilitate and promote employment and training opportunities for veterans.
  1. Provide and facilitate a full range of employment and training services, as appropriate, to meet the needs of newly separated and other veterans in the workforce development system and especially address the needs of transitioning military personnel through facilitation of TAP workshops. Examples of employment and training services may include, but are not limited to the following activities:
    a) Conduct job search assistance workshops;
    b) Provide job development and referrals;
    c) Provide vocational guidance;
    d) Provide labor market information (LMI); and
    e) Provide referrals to training and supportive services.
  1. Provide quarterly reports to the individual responsible for the management of an SDP to which the LVER has been assigned, and, through the appropriate state agency channels, to the State Director of Veterans Employment and Training (DVET). These reports are to review the following components of the SDP.
    a) Compliance with State directives on services to veterans; and
    b) Accomplishments towards meeting the State's performance standards for these services.

This reporting responsibility does not imply functional supervision over programs and services to veterans at the service delivery point. This role enables the LVER to serve as an agent of SDP manager by gathering information on the SDP's activities and efforts that address veteran customers' employment and training needs.

  1. Supervise the DVOP specialist as well as direct the activities of the Veterans’ Unit.

Manager's Report on Services to Veterans

Each LVER is required to provide local management with a written report each federal fiscal year quarter on accomplishments and other programmatic issues that occurred during that quarter. Quarterly reports submitted no later than ten working days after the last day of each federal fiscal year quarter. Every effort is made to describe each item in the report. All reports are cleared with the appropriate Regional Director, with copies forwarded to the WorkSource Operations Division's Veterans' Services Unit. Additional copies of the report form are reproduced locally.

VETS-200 Report and ETA 9002 B & D

The VETS-200 and the ETA 9002 B & D reports are produced by LMEA with data found in the SKIES automated system using the reportable activity identified in the LVER and DVOP Programs.  These reports reflect the numbers of veterans who receive services from ESD.  Such as veterans who have received Campaign Badges who are transitioning, female, special disabled, newly separated and disable veterans.  tha report also reflects what kinds of services were provided.

CASE MANAGEMENT

A veteran seeker that is in a Veterans’ Services case management status should be enrolled in the LVER or DVOP Program through the Seeker Program screen. Veteran seekers enrolled in the LVER or DVOP Program, as a Participant will be included in the data for Case Management in the federal reports. Services will not be the indicator for Case Management data. SKIES has added a Case Managed checkbox along with start date, to the Core Services/Basic/Additional screen and the Seeker Services screen. This indicator would be the data collected for Case Management reporting purposes on federal reports.
